1. User’s Acknowledgment and Acceptance of Terms
Trading Volatility (“Us” or “We”) provides the Trading Volatility, Trading Volatility Pro, and Trading Volatility+ sites and various related services (collectively, the “site”) to you, the user, subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the “Terms of Use”).
By accessing this site, you agree to be bound by these Terms and Conditions of Use, all applicable lawusers and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not wish to be bound by these Terms of Use, you are prohibited from using or accessing this site. Your remedy for dissatisfaction with this site or any products, services, content, or other information available on this site is to stop using the site, products, and/or services. Your agreement with us regarding compliance with these Terms of Use becomes effective immediately upon your entry to this site.
As used in these Terms of Use, references to "Owners"  includes site's owners, officers, directors, suppliers, partners, sponsors, and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering this site and/or its contents.
2. Description of Services
Use of this site is for informational and educational purposes only. Trading Volatility does not recommend that you buy, sell, or hold any security and does not offer investment advice, personalized or otherwise. 


Trading Volatility makes various services available on its websites including, but not limited to, stock and credit market data and metrics. Our indicator data (also sometimes referred to within the site as "Daily Forecasts") takes information about current market characteristics and places it in context of historical data points using mathematical functions that provide insight into what specific ETFs & ETNs may do based on the definitions for movement as defined within the relevant ETP prospectus and historical data. The indicators should not be construed as a prediction of any sort.

We may make additional services available via other forms of electronic and/or non-electronic communication, all of which are also covered by these Terms of Use.
We reserve the right to either modify or discontinue the site, including any of the site’s features, at any time without notice to you. We will not be liable to you or any third party should we exercise such right. Any new features that are added to this site shall also be subject to these Terms of Use.
3. Use License
Permission is granted to the user to temporarily download one copy of the materials on Trading Volatility's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
a) modify, reproduce, duplicate, forward, redistribute, sell, or resell the materials;
b) use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
c) attempt to decompile or reverse engineer any software contained on Trading Volatility's web site;
d) remove any copyright or other proprietary notations from the materials; or
e) transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Trading Volatility at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
4. Registration Data
In order to access some of the services on this site, you may be required sign in with a valid Google account. This owners of this website are not associated with Google.  You understand that additional Terms of Service may apply to you for services provided by Google. 
5. Intellectual Property Information
For purposes of these Terms of Use, “content” is defined as any information, data, and other material and services that can be viewed by users. By accepting these Terms of Use, you acknowledge and agree that all content presented to you on this site is protected by applicable copyright and trademark law and is the sole property of this site's Owners. 
We do not warrant or represent that your use of materials displayed on, or obtained through, this site will not infringe the rights of third parties. See “Unauthorized Use of Materials” below for a description of the procedures to be followed in the event that any party believes that content posted on this site infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party.
All custom graphics, icons, logos and service names are registered trademarks, trademarks or service marks of Trading Volatility or its Owners. All other trademarks or service marks are property of their respective owners. Nothing in these Terms of Use grants you any right to use any trademark, service mark, logo, and/or the name of Trading Volatility or its Owners.
6. Disclaimer of Warranties
All materials and services provided by Trading Volatility are provided on an "as-is" basis without warranty of any kind. 
Past performance of strategies identified on this site is not indicative of future results. Trading Volatility makes no representations concerning the likelihood of profitable trading using these strategies. Trading of securities, options and futures may not be suitable for all individuals and involves the risk of losing part or all of your money. You are responsible for your own financial and investment decisions and should consult a qualified financial professional for advice specific to your financial situation prior to trading securities.
Although we strive to keep our site and its content up to date and accurate, we occasionally experience outages. We provide no guarantee or warranty on the availability or accuracy of data throughout this site. This site's owners will not be held responsible for any liabilities that may arise as a result of data reporting errors or outages. Paying subscribers will be compensated for down-time at the sole discretion of the site's Owners.
You understand and agree that temporary interruptions of the services available through this site may occur as normal events. You further understand and agree that we have no control over third party networks you may access in the course of the use of this site, and therefore, delays and disruption of other network transmissions are completely beyond our control.

7. Revisions and Errata
The materials appearing on Trading Volatility's web site could include technical, typographical, or photographic errors. We may make changes to the materials contained on the web site at any time without notice. Trading Volatility does not warrant that any of the materials on its web site are accurate, complete, or current. The content at this site may be out of date, and we make no commitment to update its materials or services. 
8. Limitation of Liability
The Owners and operators of this site are not licensed investment advisers and they are not acting as an investment adviser to any users of this site. 
All content is provided solely for educational and informational purposes and should not be interpreted as advice to buy or sell any securities. All tools and information provided by the Owners of this site are made available to you for self-directed use. Visitors to this site should complete their own analysis prior to making investment decisions and are fully responsible for any investment decisions they make. Any purchase or sale of securities that you make based on information obtained from this site will be made at your own risk, and this site's Owners will not be liable for any losses that you may sustain.

You agree to defend, indemnify, and hold us and our Owners harmless from all loss, liabilities, damages, claims, costs and expenses, including attorney’s fees, that arise from your use or misuse of this site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

This site may link you to other sites on the Internet or otherwise include references to information, documents, software, materials and/or services provided by other parties. These sites may contain information or material that some people may find inappropriate or offensive. These other sites and parties are not under our control, and you acknowledge that we are not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites, nor are we responsible for errors or omissions in any references to other parties or their products and services. You acknowledge and agree that upon receipt of a notice of a claim of copyright infringement, we may immediately remove the identified materials from our site without liability to you or any other party and that the claims of the complaining party and the party that originally posted the materials will be referred to the United States Copyright Office for adjudication as provided in the Digital Millennium Copyright Act.
13. International Use
Although this site may be accessible worldwide, we make no representation that materials on this site are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws. Any offer for any product, service, and/or information made in connection with this site is void where prohibited.
14. Termination of Use
You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the site with or without notice and for any reason, including, without limitation, breach of these Terms of Use. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities.
Upon termination or suspension, regardless of the reasons therefore, your right to use the services available on this site immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or this site. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.
15. Governing Law
Any claim relating to Trading Volatility's website shall be governed by the laws of the State of California without regard to its conflict of law provisions.
16. Miscellaneous
Any cause of action brought by you against us or our Owners must be instituted within one year after the cause of action arises or be deemed forever waived and barred.
You may not assign your rights and obligations under these Terms of Use to any party, and any purported attempt to do so will be null and void. We may freely assign our rights and obligations under these Terms of Use.
If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
Any failure by us to enforce or exercise any provision of these Terms of Use or related rights shall not constitute a waiver of that right or provision.
 17. Site Terms of Use Modifications
These Terms of Use are effective as of January 1, 2013. We expressly reserve the right to change these Terms of Use without notice to you. You acknowledge and agree that it is your responsibility to review these Terms of Use every time you visit this site. Your continued use of this site will constitute agreement to be bound by the Terms of Use.

- Our Members' Forum utilizes your Google account to post and read messages. If you choose to post messages to the Forum your email address will be visible to all group members.
